We reserve the right, at our discretion, to modify or update these Terms at any time. Your continued use of the website signifies your acceptance of those changes.
1. Language
These Terms & Conditions and all related communications, documents, and legal proceedings shall be conducted in the English language, which shall prevail over any translation provided for convenience.
2. Eligibility to Use Our Site
Use of this website is available only to individuals and business entities who can legally enter into binding contracts under applicable law. Users under the age of 18 or otherwise “incompetent to contract” under the Indian Contract Act, 1872 are not eligible to use this site. We reserve the right to terminate or suspend your access if we discover that you do not meet these requirements.

While you can browse the website as a guest, registered business users enjoy access to additional features such as bulk pricing, quotation requests, and order tracking. When registering, you agree to provide accurate, current, and complete information about your company and contact person. BMI reserves the right to suspend or terminate accounts that contain false or incomplete information, or are used for any unlawful activity.
4. Electronic Communication
By visiting www.bmionline.in, contacting us, or placing an order online, you consent to receive communications from us electronically. This may include emails, SMS updates, invoices, or website notifications. You agree that all such communication satisfies any legal requirement that such communications be in writing.
5. Product Information, Pricing & Availability
While we strive to ensure accuracy in product descriptions, images, specifications, and pricing, errors may occasionally occur. In case of an incorrect price or product listing, BMI reserves the right to correct it or cancel the affected order. All prices are listed in Euro (EUR) unless otherwise stated and are subject to change without prior notice. Product availability may vary, and placing an item in your cart does not guarantee stock.
6. Quotation Requests
You can place requests for Quotations for product pricing. BMI reserves the right to accept or reject any quotation, in whole or in part, at our discretion.
7. Orders & Acceptance
Your order constitutes an offer to purchase our products. Once an order is placed, you will receive an acknowledgment email. However, this does not signify acceptance. BMI reserves the right to accept or reject any order, in whole or in part, at our discretion. Orders are confirmed only after full or partial payment, depending on our sales policy. Custom or made-to-order items cannot be cancelled once production has begun.
8. International Trade Compliance
Buyers are responsible for ensuring that the import, purchase, or use of BMI products complies with all applicable import laws, trade sanctions, and export control regulations in their country. BMI shall not be liable for any violation of such laws by the buyer. We reserve the right to refuse or cancel any order that, in our reasonable judgment, may contravene such laws or regulations.
9. Shipping Terms
All international shipments shall be governed by Incoterms® 2020 as published by the International Chamber of Commerce (ICC). Unless otherwise specified in writing, shipments will be made on an FOB India Port basis, and the buyer shall bear all costs and risks associated with transportation, insurance, import duties, and customs clearance once goods are handed to the carrier at the port of shipment.
10. Payment Terms
We accept payments through approved gateways and bank transfers. All payments must be made in full before dispatch unless you have a pre-approved credit arrangement with BMI.
All payments must be made in the currency stated on the invoice. Buyers are responsible for all bank transfer charges, currency conversion fees, duties, taxes, customs charges and intermediary bank deductions. Payment shall be considered complete only when the full invoice amount is credited to BMI’s designated bank account.
11. Shipping, Delivery & Risk
All shipments are handled through our approved logistics partners. Estimated delivery timelines are provided for reference only and may vary due to external factors such as customs, transit delays, or unforeseen circumstances. Risk of loss passes to the buyer once the shipment is handed over to the carrier.
BMI shall not be held liable for any failure or delay in performance arising from events beyond our reasonable control, including but not limited to natural disasters, war, embargoes, strikes, labor disputes, transportation delays, government restrictions, or global supply chain disruptions. In such cases, delivery schedules shall be extended accordingly or the contract may be suspended without liability.
12. Returns, Replacements & Damages
As our products are handcrafted and often made-to-order, minor variations in color, texture, or finish are part of the design process and do not qualify as defects. Claims for damage or defect must be reported within 48 hours of delivery with photographic evidence. Approved claims will be resolved through replacement, repair, or partial refund at BMI’s discretion.
13. Intellectual Property Rights
All content, photographs, text, designs, product images, graphics, and other materials appearing on www.bmionline.in are the exclusive property of BMI. Unauthorized use, reproduction, or distribution of any material from this site is strictly prohibited.
14. User Submissions & Feedback
Any feedback, ideas, or suggestions shared with us (through email, contact forms, or otherwise) shall become the property of BMI without any obligation to compensate you. You agree that such submissions do not infringe on any third-party rights.
15. Limitation of Liability
BMI and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use our website, including but not limited to delays, lost profits, data loss, or business interruption.
16. Governing Law & Dispute Resolution
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms shall first be resolved through mutual negotiation. If unresolved, disputes shall be finally settled by arbitration in Moradabad, Uttar Pradesh, India, in accordance with the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall be conducted in English, and the award shall be final and binding on both parties.
The courts of Moradabad, Uttar Pradesh, India shall have exclusive jurisdiction for all matters not subject to arbitration..
17. Data Protection & Privacy
We are committed to protecting your privacy. Personal and business data collected through www.bmionline.in shall be used solely for the purpose of processing orders, quotations, and business communication. For EU clients, BMI complies with the principles of the General Data Protection Regulation (GDPR). We do not sell or share your information with third parties except as required to fulfill orders or comply with legal obligations.
